Llewellyn is a senior associate in our commercial recovery and restructuring team.

After practising for four years at the Sydney Bar, Llewellyn has acquired a wealth of experience in general commercial litigation and dispute resolution. He has acted for and against construction companies with respect to claims arising out of breach of contract/defective works and in relation to claims made pursuant to the Building and Construction Industry Security of Payments Legislation.

Llewellyn has also acted in various kinds of disputes concerning partnerships/joint ventures and an array of other commercial causes which, on most occasions, also concerned alleged contraventions of the Trade Practices Act 1974.

Qualifications

  • Diploma in Law, Legal Practitioners Admission Board, Sydney
  • Bachelor of Arts, University of Sydney
  • Admitted as a solicitor in the Supreme Court of Queensland and the High Court of Australia
  • Formerly practiced as a barrister at the Sydney Bar

Recent projects

  • Provided pre litigation advice in relation to the dissolution of a partnership which had been carrying on an apiary business.
  • Acted for a number of companies, in separate proceedings in the Supreme Court of New South Wales, advancing and defending applications to set aside statutory demands;
  • Acted in proceedings commenced in the District Court of New South Wales on behalf of a finance company seeking damages from a defaulting borrower for breach of a loan agreement secured by an unregistered mortgage. 
  • In proceedings commenced in the District Court of New South Wales by the head contractor of a residential housing development, Llewellyn acted for electrical contractors defending allegations of defective workmanship and misleading and deceptive conduct.
  • Acted in proceedings commenced in the Consumer Trader Tenancy Tribunal (New South Wales) for a construction company in relation to various causes of action but principally defending allegations of defective workmanship and delay.
  • Defended a rubbish collection/disposal company in prosecution proceedings in the Land and Environment Court of New South Wales for admitted contraventions pursuant to the relevant state based environmental protection legislation.
