Payment in the building industry is traditionally one of the hardest phases of the construction process. There are numerous ways to enforce payment, some of which are mutually exclusive. For contractors and subcontractors, we can work through them with you to ensure the most practical and cost-effective means of recovery. For developers, owners and principals, we are experienced in defending these claims and work to ensure the most efficient means of resolving those disputes.

For example, the Building and Construction Industry Payments Act 2004 (BCIPA) provides a fast and effective method of recovering money due under construction contracts, but the BCIPA procedures contain many potential pitfalls for both claimants and respondents which, if not properly navigated, can lead to disastrous results. Our team has vast experience in both making and defending BCIPA payment claims, and can provide the up-to-date advice and expertise necessary to enable clients to make the most out of the Act.

We also regularly provide advice to clients on the operation of their construction contracts, and recommend strategies that enable them to avoid disputes, and to properly protect their interests for when disputes do arise.
